Brian McNamara enjoys both his roles as an attorney. As an advocate, he aggressively pursues his clients' interests at trial, but only after carefully fulfilling his role as legal counselor and making every effort to resolve the case by agreement. Mr. McNamara has extensive experience trying family law and business cases before both juries and judges. Throughout his practice, he has tried many types of jury cases from child custody, to business litigation, to consumer and injury cases.

More importantly, Mr. McNamara has settled many more cases than he has tried. The certainty provided by a settlement and the cost-savings versus trial are powerful incentives to avoid the courtroom when possible. Experience has often demonstrated the irony that the better a case is prepared for trial, the more likely it is to settle.

Mr. McNamara was licensed in May, 1992, and was lead counsel in two jury trials within a year. Since then, he has completed many more trials, some before juries and countless non-jury bench trials. A jury trial victory he won in 2004 was appealed by the opponent, and the Court of Appeals recently issued its opinion upholding the trial court's decision in favor of Brian's client.

Since 1992, Brian has concentrated his practice in the areas of family law and business litigation. He also drafts wills and can help you with probate court matters. He has represented husbands and wives in divorces, and all types of child custody and support cases. Although Brian has represented clients with estates worth millions, the majority of his divorce clients are suburban middle-class professionals with a variety of assets and debts. He has made a point of understanding the various types of financial products commonly in use today. Child custody matters vary from disagreements about who the children will live with after a divorce, to post-divorce child support and visitation arrangements.

Mr. McNamara also has extensive experience with business litigation. The firm is counsel to small- and medium-sized businesses and, occasionally, litigation becomes necessary. He has tried cases before judges and juries on issues ranging from alleged defective products and services, unpaid invoices, undelivered products or services, and real property issues. His philosophy is to try to resolve business disputes as directly as possible at the least cost to the client, which means trying to find an agreement, if possible.

Brian has practiced in Kingwood since 1992. He is a Kingwood resident and his three children attended Kingwood schools. He is a member of the Humble Chamber of Commerce and is involved with the Lake Houston YMCA Youth in Government Program as an evaluator of mock trial contestants. Brian has previously held several officer positions with the Northeast Harris County Bar Association, including president. He is a member of the Houston Bar Association's Litigation and Family Law sections; the State Bar of Texas's Litigation and Family Law Sections; and the Montgomery County Bar Association. He is also a member of the College of the State Bar of Texas, an honorary society of lawyers who attend at least double the required hours of continuing legal education required by the State Bar of Texas.
